The Supreme Court, with decision no. 436/2026, held that a non-competition agreement entered into in the context of an employment relationship was valid, finding that the requirement that the subject matter of the contract, determined or determinable, was met, even though the amount of the payment of the non-competition was linked, amongst other things, to the duration of the employment relationship.
