The Supreme Court, with decision no. 30212/2025, stated that for the purposes of determining the territorial jurisdiction of the court in cases involving the sale of products in violation of industrial property rights on the Internet, the place where the offence was committed, i.e. where the infringing conduct took place, is to be understood as the place of establishment of the advertiser where the technical process aimed at displaying the advertisement and concluding the purchase (including payment of the consideration) was initiated or, alternatively, the place where the company managing the website is based, and not the place where the product was actually delivered.
