Ambush Marketing

The State Council, with judgment no. 3118/2025, confirmed the fine of Euro 100,000.00 imposed by the AGCM on Zalando for parasitic advertising activity (ambush marketing) pursuant to art. 10, paragraphs 1 and 2, Law Decree no. 16/2020 (converted by Law no. 31/2020) consisting of having placed, in Piazza del Popolo in Rome, which was hosting the ‘Football Village’ of ‘UEFA Euro 2020’, a billboard displaying the expression ‘Who will be the winner? ', the name of Zalando, the representation of the 24 flags of the nations participating in the football event and a white shirt with the distinctive logo of Zalando. The State Council stated that people seeing the billboard could be misled into believing that Zalando was one of the sponsors of the football event.
