CE marking (China Export)

The Italian Criminal Supreme Court, with judgement no. 7273/2024, stated that the affixing of the CE marking (China Export) on goods intended for sale, which is a counterfeit of the CE marking provided for by the European Union, constitutes the offence of attempt to commit fraud in the exercise of trade, since it erroneously misleads the consumer into believing that the goods have the characteristics and European standards, since the affixing of the CE marking by the manufacturer has the function of certifying the conformity of the product with the essential requirements of the European market and this certification in itself constitutes an essential qualitative element of the product
